Terms of Reference.

The Committee will examine the bridges and
culverts of the British section of the Kowloon Canton
Railway and in particular the foundations of the ajor
Bridges, especially those in which any settlement has
occurred. Where these (or other works) are included in
a contract, they will record their opinion, looking to the
dates on which sections of work were passed and the other
conditions governing pecuniary responsibility, on whom
that responsibility rests. Should there however he any
difficulty in arriving at an opinion in this matter,
involving the taking of evidence, examination of witnesses etc. they will refer the matter to me before proceeding to
do so.
Should they record their opinion that in any par- ticular instance the construction has been faulty, they will state whether they recomend that work should be sus- pended, and whether the bridge etc may probably require to be completely reconstructed and for what reason.
They will report on any other matters of con- struction which may come to their notice regarding which in their opinion it would be advisable for me to be informed. The enquiry will be "without prejudice" to legal rights.
